Terms and conditions
Purchase of Pinnacle Climate Technologies Products Is Subject To The Following Terms and Conditions.
Pinnacle Climate Technologies’ goal is to ship products on or within the lead time quoted at the time of order submission. Quoted lead times do not include shipping time and will range from 24 hours for in-stock, pre-assembled products to several weeks for large orders and/or out-of-stock products. Lead times quoted at the time of order submission are estimates and may change unexpectedly. Lead times are based upon Pinnacle Climate Technologies’ best judgment and are subject to factory schedules, available materials and production limitations, and are not guaranteed. Pinnacle Climate Technologies’ will make a reasonable effort to inform customers of any material change in projected lead times. Pinnacle Climate Technologies will not be liable in any way for unmet lead times, independent of the cause will not pay for expedited shipping nor allow deductions from invoices due to unmet lead times.
Reseller agrees not to resell any product via any online marketplace-commerce site such as eBay, Amazon, or other such third-party websites, which may or may not support a physical storefront. All exceptions require prior written consent from Pinnacle Climate Technologies.
Pinnacle Climate Technologies monitors inventory levels on Amazon and other eCommerce sites to reinforce reseller policy compliance. Failure to comply may result in immediate termination of future wholesale pricing or sales from Pinnacle Climate Technologies.
PAYMENT METHODS AND TERMS
Pinnacle Climate Technologies accepts the following forms of payment: company check, MasterCard/Visa credit card, wire transfers, and money orders. On approved credit, payment is due net thirty (30) days from the date of shipment. Accounts more than 30 days past due will accrue finance charges of 1.5% per month. A complete credit application is required for open account terms to be established. All credit terms and arrangements are subject to the determination of Pinnacle Climate Technologies’ credit department. If in the judgment of Pinnacle Climate Technologies, the financial condition of the customer does not justify open account credit terms, Pinnacle Climate Technologies will require full payment prior to shipment.
CREDIT CARD FEES
When paid in advance by credit card, Pinnacle Climate Technologies waives credit card fees for orders up to $1,000 in any calendar month. Orders exceeding $1,000 in any calendar month will be charged the 2.5% processing fee. Accounts with approved credit will be charged a 2.5% processing fee if credit terms are used and then the account is paid by credit card.
FREIGHT AND COST OF SHIPPING
Orders unable to ship small parcel posts will be shipped common carrier. All shipments are F.O.B. Pinnacle Climate Technologies factory, distribution centers or field warehouses. For shipments outside the contiguous United States, contact Pinnacle Climate Technologies Customer Care Center for applicable terms and conditions.
Shipping fees are paid by the customer and invoiced in accordance with the customer’s credit terms. Shipping fees quoted at the time of order submission are estimates. Actual shipping fees may differ from estimates and customers will be required to pay the actual amount. Pinnacle Climate Technologies reserves the right to select the carrier and to route shipments at our discretion. Pinnacle Climate Technologies will ship in the manner selected by the customer; however, the customer assumes any additional transportation and delivery costs.
TRANSPORTATION DAMAGE CLAIMS
Pinnacle Climate Technologies products are tested for defects prior to shipping. Packaging is regularly inspected by transportation authorities who assume responsibility for both apparent and concealed damages sustained by improper handling. Title passes to the customer upon delivery by Pinnacle Climate Technologies to the carrier. Pinnacle Climate Technologies assumes no responsibility for damages incurred in transit. Once the customer signs for a shipment, the customer has taken possession and Pinnacle Climate Technologies is unable to file a freight claim on behalf of the customer. Shipments found crushed, punctured, broken, delivered short, or otherwise damaged should not be accepted from the carrier and should be returned to Pinnacle Climate Technologies. Pinnacle Climate Technologies must be notified immediately of the return to arrange for replacement shipment at no cost.
RETURN OF STOCK MERCHANDISE
No merchandise may be returned without a Return Authorization from the Pinnacle Climate Technologies Customer Care Center. Return Authorization must be obtained within 30 days of the date of purchase. Return Authorizations expire 30 days after the date of issue and will not be re-issued.
All returns must be shipped prepaid to the Pinnacle Climate Technologies location designated on the Return Authorization. For standard products in “like new” condition, a credit will be issued minus a 25% restocking fee and any unpaid freight charges, after receipt and inspection of the product at Pinnacle Climate Technologies. For custom products and standard products returned in less than “like new” condition, the restocking fee will be determined upon inspection and will range from 30% to 100%. Obsolete products are not returnable.
CHANGES TO TERMS AND CONDITIONS
Terms and Conditions are subject to change without notice. The most current Terms and Conditions apply to any order and are available on the Pinnacle Climate Technologies website.
Shipping and Receiving Policy
Pinnacle Climate Technologies (PCT) prides itself on going the extra mile to utilize the best freight carriers for service at reasonable rates. Unfortunately, freight damage may still occur. It is the responsibility of the consignee to inspect all shipments before accepting goods from any carrier.
Pinnacle assumes no responsibility for damages occurring in transit. All deliveries with missing items or visible damage, (ripped, dented, broken, crushed, etc.) must be noted on the bill of lading or delivery receipt and immediately reported to PCT. Damages and freight claims will not be processed after 10 business days of accepting delivery. No Exceptions.
DAMAGED OR MISSING ITEMS
- Any issue(s) MUST be notated on the Receipt of Delivery or Bill of Lading.
- Contact Pinnacle Climate Technologies Customer Care Center.
- PCT will contact the carrier, fill out the appropriate paperwork and file the freight claim.*
- PCT will send the customer replacement(s) at no charge.*
- Verify with the carrier if we are required to use them for the replacement shipment (some require this and others do not).
- Customers must be compliant with the carrier’s reasonable requests for viewing and inspecting packages.
- PCT is unable to file claims that are sent Collect or 3rd Party Collect.
Note: Once you/your customer signs, you/they take possession/ownership of the product.
- You or your customer (in case of drop ship) is responsible for contacting the carrier, filling out the appropriate paperwork, and filing the freight claim. The company or individual filing the claim will be reimbursed by the freight carrier.
- If a replacement shipment is requested, a new sales order must be submitted through our Customer Care Center, or by email at email@example.com.
- The same carrier must be used for the replacement order.
It is the customer’s responsibility to inspect the products within a reasonable time frame. Concealed damage claims must be filed within 10 days of the receipt of the shipment. No Exceptions.
Pinnacle Climate Technologies, Inc. warrants this product to the original retail purchaser only, to be free from defects in material and workmanship for a period of one (1) year from the date of initial purchase. This product must be properly installed, maintained, and operated in accordance with the instructions provided. This Limited Warranty is in lieu of all other express warranties. Pinnacle Climate Technologies, Inc. disclaims all warranties for products that are purchased from sellers other than authorized retailers or distributors.
Pinnacle Climate Technologies, Inc. requires reasonable proof of your date of purchase from an authorized retailer or distributor. This Limited Warranty shall be limited to the repair or replacement of parts, which prove defective under normal use and service within the warranty period, and which Pinnacle Climate Technologies, Inc. shall determine at its reasonable discretion. This warranty does not apply to products purchased for rental use.
This Limited Warranty does not cover replacement of belts or tightening of belts, or any failures or operating difficulties due to normal wear and tear, accident, abuse, misuse, alteration, misapplication, improper installation or improper maintenance and service by you or any third party. Failure to perform normal and routine maintenance on the fan, shipping damage, damage related to insects, birds, or animals of any kind, and damage due to weather conditions are also not covered. In addition, the Limited Warranty does not cover damage to the finish, such as scratches, dents, discoloration, rust or other weather damage, after purchase.
All transportation costs for the return of the damaged product or parts will be the responsibility of the purchaser. Upon receipt of the damaged item, Pinnacle Climate Technologies, Inc. will examine the item and determine if defective. Pinnacle Climate Technologies, Inc. will repair or replace and return the item, freight pre-paid. If Pinnacle Climate Technologies, Inc. finds the item to be in normal operating condition, or not defective, the item will be returned freight collect.
AFTER THE PERIOD OF THE ONE (1) YEAR LIMITED WARRANTY EXPIRES, Pinnacle Climate Technologies, Inc. DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR APPLICATION. FURTHER, Pinnacle Climate Technologies, Inc. SHALL HAVE NO LIABILITY WHATSOEVER TO PURCHASER OR ANY THIRD PARTY FOR ANY SPECIAL, INDIRECT, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
Pinnacle Climate Technologies, Inc. assumes no responsibility for any defects caused by third parties. This Limited Warranty gives the purchaser specific legal rights; a purchaser may have other rights depending upon where he or she lives. Some states do not allow the exclusion or limitation of special, incidental or consequential damages, or limitations on how long a warranty lasts, so the above exclusion and limitations may not apply to you. Pinnacle Climate Technologies, Inc. does not authorize any person or company to assume for it any other obligation or liability in connection with the sale, installation, use, removal, return, or replacement of its equipment, and no such representations are binding on Pinnacle Climate Technologies, Inc.
