OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.
ELIGIBILITY
Sweepstakes participants must: (a) be a resident of the United States or Canada, (b) be at least 18 years of age at the time the sweepstakes begins. Void where prohibited or restricted by law.
This Sweepstakes is sponsored by Pinnacle Climate Technologies (“Sponsor”). All employees, officers, directors, and agents, and their immediate families and members of their households, regardless of relationship, of Sponsor, or any advertising agency or other company involved with the design, production, execution or distribution of this Sweepstakes (“Promotion Supporters”) are not eligible to participate in the Sweepstakes or to win any prizes.
By participating in this Sweepstakes, entrants accept and agree to be bound by these Official Rules and the decisions of Sponsor, which shall be binding and final in all respects. The Sweepstakes is governed by these Official Rules and is subject to all applicable federal, state and local laws.
SWEEPSTAKES PERIOD
The Sweepstakes will begin on June 6,2024 at 9:00 AM (CTD) and ends June 8, 2024 at 11:59 PM (CTD) (“Sweepstakes Period”). All Entries must be received and recorded by Sponsor during the Sweepstakes Period to be eligible. Sponsor’s computer systems will be the official timekeeping systems for the Sweepstakes.
HOW TO ENTER
There is one option to earn entry into the Sweepstakes (each, an “Entry”): Fill out the form above and submit to Pinnacle Climate Technologies. Limit one Entry per person. Duplicate entries will be disqualified. Sponsor is not responsible for misdirected, late, unsent, incomplete, illegible or unintelligible Entries or for inaccurate information included with any Entry, whether caused by the participant or by any device, equipment, Internet connection or technology associated with or utilized in this Sweepstakes, or by any technical or human error that may occur in the transmittal of any Entry or the processing of any function on the entrant’s computer system or mobile device. Participant must notify Sponsor of any changed contact information within the Sweepstakes Period to remain eligible to win based on Entry. Any disputes regarding the ownership of an account will be determined by Sponsor. Any Sweepstakes entries received from an ineligible participant will be disqualified. Sponsor reserves the right, in its sole discretion, to disqualify any individual found to be tampering with the Entry process or the operation of the Sweepstakes; to be acting in violation of these rules; or to be acting with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, programmed or similar response methods will void all such entries submitted by such methods.
PRIZES
The Sweepstakes prize includes one Heat Hog 9,000 BTU portable propane heater (the “Prize”). No transfer, assignment, cash redemption or substitution of any Prize is permitted, except by Sponsor due to Prize availability and then with a Prize of equal or greater value. The approximate retail value (ARV) of all Prizes will depend on exchange rates but is approximately $150 USD. Determination of the Prizes to be awarded will be in Sponsor’s sole discretion.
RANDOM DRAWING; ODDS OF WINNING
On or about February 23, 2024, a total of one potential winner will be randomly selected from all eligible Entries received during the Sweepstakes Period. The odds of winning will depend on the number of eligible Entries received during the Sweepstakes Period.
Sponsor or Promotion Supporters will notify the potential winner by email. The potential winner must respond within five (5) business days of being notified or the Prize may be forfeited and another Sweepstakes participant chosen. Potential winners must satisfactorily complete an affidavit of eligibility showing compliance with these Official Rules and must also sign a liability and publicity release, allowing Sponsor to use his or her information for advertising and other purposes. In the event that the potential winner is disqualified for any reason, Sponsor may select an alternate potential winner by random drawing from among all remaining eligible entries. If a potential winner fails to satisfy these requirements, is deemed ineligible, or is disqualified for any reason, Sponsor may select an alternate potential winner from among all remaining eligible Entries. Winners are solely responsible for all applicable federal, state, and local taxes and any expenses associated with any Prizes. If Sponsor determines that no eligible entries have been submitted, Sponsor reserves the right not to award a Prize.
Sponsor reserves the right, in its sole discretion, to modify, terminate, or suspend this Sweepstakes for any reason, including due to an unanticipated occurrence or event, computer virus, tampering, fraud, mechanical or technical issue, unauthorized human intervention, or other causes beyond Sponsor’s control corrupt or impair the administration, security or fairness of the Sweepstakes. Sponsor is not responsible for any human, mechanical or technological error that may occur in the processing of the Sweepstakes, nor is Sponsor responsible for any error, omission, interruption, deletion, defect, communications line failure, theft or destruction of, unauthorized access to, delay in operation, transmission, or distribution of, or alteration of Entries, whether caused by the sender, any of the equipment or programming associated with or utilized in this Sweepstakes, or otherwise. ANY ATTEMPT TO DELIBERATELY DAMAGE OR INTERFERE WITH ANY WEBSITE, ENTRY, ALGORITHM OR PROCESS, OR TO UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND, SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY RESPONSIBLE PARTIES, TO THE FULLEST EXTENT PERMITTED BY LAW.
LIMITATION OF LIABILITY AND DISPUTE RESOLUTION
Entrants and the winner are solely responsible for their own actions relating to this Sweepstakes and TO the acceptance and/or use of a Prize. By participating in this Sweepstakes and/or by acceptance or use of a Prize, all entrants and winners agree to release and hold harmless Sponsor and Promotion Supporters, and their respective parent companies, affiliates, subsidiaries, retailers, agencies, officers, directors, employees and agents from and against any liability arising in connection with the Sweepstakes and/or use of a Prize. PRIZES ARE AWARDED “AS IS” WITH NO WARRANTY OR GUARANTEE, EXPRESS OR IMPLIED. SPONSOR DISCLAIMS ALL AND ANY LIABILITY ASSOCIATED WITH PARTICIPATING IN THE SWEEPSTAKES. ENTRANTS MUST FOLLOW ALL LAWS WHEN PARTICIPATING IN THE SWEEPSTAKES. SPONSOR AND PROMOTION SUPPORTERS DISCLAIM ALL LIABILITY FOR THE PROVISION, QUALITY OR NATURE OF ANY PRIZE, INCLUDING A PRODUCT OR SERVICE PROVIDED BY A THIRD-PARTY, EVEN IF SUCH THIRD-PARTY IS AFFILIATED WITH SPONSOR OR PROMOTION SUPPORTERS. SPONSOR AND PROMOTION SUPPORTERS ARE NOT RESPONSIBLE FOR ANY PERSONAL INJURIES, PREMISES LIABILITY, DAMAGES, THEFT, MISCONDUCT, OR OTHER LIABILITY ARISING, DIRECTLY OR INDIRECTLY, FROM PARTICIPATION IN THE SWEEPSTAKES OR ACCEPTANCE, POSSESSION, USE OR MISUSE OF A PRIZE.
Except where prohibited, each participant and winner accepting a Prize agrees that: (a) all issues and questions concerning these rules shall be governed by Minnesota law without giving effect to any principles of conflicts of law of any jurisdiction; (b) any and all disputes, claims and causes of action at law or in equity arising out of or relating to this Sweepstakes or any Prize awarded shall be (i) resolved individually, without resort to any form of class action; and (ii) filed only in the state courts situated in Minnesota, and participant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such disputes, claims or causes of action; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event shall include attorneys’ fees; and (d) under no circumstances will any participant or winner be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

Requests must be received no later than one (1) month after the end of the Sweepstakes Period.
